Lawyers Condemn DSS Assault on Judiciary and Re-arrest of Political Detainee, Emefiele
In a shocking display of force and disregard for the rule of law, the Department of State Services (DSS) came under fire from Human Rights Lawyers under the aegis of Lawyers in Defence of Democracy (LIDD), for assaulting judiciary officials, prison authorities, and media personnel. The incident revolved around the re-arrest of the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, against a court order. This clash between the DSS and prison officials has raised concerns about the sanctity of the judiciary.

On Tuesday, the Federal High Court in Ikoyi, Lagos, ordered the Nigerian Correctional Service (NCoS) to take custody of Emefiele . However, shortly after the ruling, DSS operatives allegedly attempted to whisk Emefiele away to their detention center, sparking a heated confrontation between the secret police and prison officials.
The court’s orders clearly stated that until Emefiele’s bail conditions were met, he should remain in the custody of the Nigerian Correctional Services (NCoS). The court also signed a remand warrant, granting the Correctional Services (NCoS) the authority to take custody of Emefiele. However, during the execution of their constitutional mandate and in obedience to the court’s order, a distressing incident unfolded. A high-ranking official of the Nigerian Correctional Services was subjected to physical assault, beaten, and disgracefully stripped in the presence of camera men as the confrontation between the DSS operatives and the NCoS operatives escalated into a physical altercation.
The DSS operatives managed to take custody of Emefiele, further flouting the court’s order and raising questions about the agency’s actions. Human Rights Lawyers, represented by Barr. Okere Kingdom, have decried the DSS’s actions, calling for Mr. Bola Ahmed Tinubu to intervene and demonstrate a commitment to upholding the rule of law.
During the DSS’s attempt to rearrest Godwin Emefiele, his defense team promptly informed the court, as the court was still sitting when the attempt was made. Subsequently, the court summoned the leader of the DSS team to appear before it. Joseph Godwin Daudu SAN, the leader of Godwin Emefiele’s defense team and a former president of the NBA, was asked to repeat what he had stated in court in the presence of the DSS team leader, which he did. When confronted with allegations that they were attempting to flout court orders, the DSS team leader informed the court that he had received orders from above to take Mr. Godwin Emefiele to Abuja.
In a statement, the lawyers condemned the DSS’s “rogue and tasteless behavior,” emphasizing that the agency lacked constitutional authority to re-arrest Emefiele. They called on Mr. Tinubu to prove that he has regard for the rule of law by suspending and ordering the arrest of Yusuf Bichi, the DSS Director General.
Frank Tietie, an analyst and lawyer, expressed his concern over the incident, stating, “An official of the Nigerian Correctional Service (NCoS) was dragged, his uniform torn, and humiliated in front of onlookers? The DSS engaged in a show of force against another agency licensed to bear arms. Can you imagine that? It is now evident that Emefiele is a political detainee due to his past political views”. He described the actions of the DSS as an invitation to anarchy.
The incident has brought to the forefront concerns about the independence of the judiciary and the need for accountability in law enforcement agencies. The clash between the DSS and prison officials has left the public in dismay, with many wondering what the DSS aims to achieve with its mischievous actions and constant disregard of court orders.
